Terms of use
These terms are the licence for DivePMS. They apply from the day you create an account or install the software.
Who you are contracting with
Pieter du Toit, a sole proprietor trading as DivePMS. Physical address: 11 Dahlia Avenue, Velddrif, Western Cape, 7365, South Africa. Email: hello@getsiteready.co.za. Telephone: 081 459 4741. DivePMS is a sole proprietorship, not a registered company. These are the supplier details required by section 43 of the Electronic Communications and Transactions Act 25 of 2002.
The licence
You receive a non-exclusive, non-transferable subscription licence to use DivePMS for your own commercial diving plant. You do not buy the software. You may not resell it, rent it, or share an activation so that more computers run it than the plan allows.
Plans, spreads, and computers
- Trial: 1 spread and 2 PCs for 30 days, no card.
- Single Spread: R2 500 a month, 1 spread, 2 PCs.
- Contractor: R5 500 a month, 3 spreads, 5 PCs.
- Fleet: R9 500 a month, 6 spreads, 10 PCs. Further spreads are by quote.
Paired Field phones are unlimited on every plan. They follow the office PC they are paired with.
Prices are in South African rand. We are not VAT-registered, so no VAT is charged.
After a lapse or cancellation
You can cancel at any time. Access continues until the end of the period already paid. After that the licence token is marked lapsed and DivePMS becomes read-only: you can still open records, export the plant file, and build an audit pack. Editing stays locked until the subscription is paid again. Data is not deleted by DivePMS when a subscription lapses.
Not an IMCA or DNV approval
DivePMS is aligned with the kind of planned-maintenance record a diving contractor keeps. It is not IMCA-certified, DNV-approved, or IMCA-endorsed. Names such as IMCA, DNV, Kirby Morgan, and Bauer are used only to describe the sort of plant contractors already own. You must hold the official publications you rely on. DivePMS is not a substitute for DESIGN documents, class rules, or a regulator’s requirements.
You remain responsible for competent-person examinations, sign-off, and statutory records. The software does not appoint a systems technician and does not decide that plant is fit to dive.
Your data and backups
Plant data, photographs, and names of people on work orders stay on your PC and your local network. You are responsible for backups, for keeping that PC available, and for any loss of locally stored data. A subscription does not include off-site storage of the plant file.
Liability
DivePMS is a record-keeping tool used around work that can injure people. To the extent the law allows, Pieter du Toit is not liable for diving operations, for a decision to use or quarantine plant, for statutory penalties, or for lost local data. Liability for the software itself is limited to the fees you paid for DivePMS in the three months before the claim. Nothing in these terms limits liability for gross negligence or for death or injury where South African law does not allow that limit.
Law
South African law applies. The courts of South Africa have jurisdiction.
Third-party open-source notices ship with the Windows installer.
